  1. General terms and conditions

1.1 Proprietor of these general terms and conditions (GTC) and responsible for the content of the above-mentioned websites:

1.2 Application of terms and conditions, required registration
These terms and conditions rule the relationship between the proprietor (see 1.1) and a consumer a.d.u. § 13 BGB or entrepreneur a.d.u. § 14 BGB as user of one of the websites/ services offered on the websites mentioned under A). Provisions that solely apply to entrepreneurs a.d.u. § 14 BGB will be detailed separately. All websites of the proprietor can be used without personal registration.

1.3 Technical leads, exclusion of liability in case of unattainability
Website maintenance activities may negatively affect the accessibility of the website. Maintenance activities will be executed as discreet as possible for the users. Regular or scheduled maintenance activities will be executed at times of low traffic and when necessary announced in advance. Additionally, unannounced maintenance activities may occur in case of unforeseeable disturbances (e.g. cyber attacks, viruses). The proprietor is not liable for the accessibility of the websites for the user with exception of the regulations under 3.5.

1.4 Liability for own content
The content of all websites is compiled with utmost possible accuracy to the best of our knowledge and conscience. Nevertheless, the proprietor does not guarantee that website contents are up to date, complete and correct.

1.5 Liability for external content
The proprietor is not liable for external contents (with the exception of liability based on the principles of liability for disturbances from the point in time of awareness of an established breach of law). The Proprietor generally does not check and monitor external contents. External contents will be blocked or deleted immediately once sighted and classified as breach of law.

1.6 External Links
The websites contain so-called ‘external links’ to other websites. The proprietor does not have any influence on the contents of such other websites. Hence, the proprietor does not provide warranty for such external website contents.

Content and correct display of information is the responsibility of the respective website provider. Before linking to external websites the website content is screened for obvious breaches of the law. In case of an open breach of the law, links will not be set. Apart from that, the proprietor is only liable following the note of a concrete breach of law based on the principles of liability for disturbances from the point in time of awareness of an established breach of the law. Such a circumstance qualifies for the proprietor to immediately remove the link.

1.7 Intellectual property rights
All contents creations and provided information that is published on these websites underlie the German intellectual property laws and ancillary copyright. No part of these websites may be duplicated, edited, distributed, saved or used in any way outside the intellectual property regulations unless explicitly agreed upon by the proprietor in a written statement. Any unlawful copying/saving or provision of information from these websites will be prosecuted under the civil or criminal law.

1.8 Liability limitation
Independent from the legal case made, the proprietor is liable only in case of damage caused through mild negligence violating essential duties (cardinal duties), i.e. duties, that are a requirement to fulfilling the purpose of the contract or duties the contractual partner can trust on being delivered on a regular base. In case of breach of cardinal duties, a liability of the proprietor is limited to the replacement of the typical damage the proprietor could assume at the point of signing the contract. Apart from this case, a liability of the proprietor in case of mild negligence is precluded.

Liability limitations do not apply in the following cases:
– Claims of the customer due to damages from injury to life, body and health,
– Rights and claims of the customer in case of malicious deception by the proprietor,
– Claims and rights of the customer, which are based on an intentional or grossly negligent behavior of the proprietor herself, their legal representatives or vicarious agents.

For these exceptions, only the legal provisions remain.

1.9 Change of terms and conditions
The proprietor retains the right to change or amend the terms and conditions at any given point in time.

1.10 Final provisions, contractual language, applicable law and jurisdiction
The respective current version of the GTC is stored on the Internet pages of the proprietor and is generally accessible.

For the purpose of complying with the contract, the proprietor may also use third parties as so-called vicarious agents. This does not apply to the conduct of the coaching sessions themselves.

Claims against the proprietor may not be assigned to third parties either wholly or in part.

The contract languages are German and English.

The right of the Federal Republic of Germany shall apply to legal disputes. The provisions of the Vienna UN Convention on contracts for the international sale of goods of 11 April 1980 do not apply.

The mandatory provisions of the legal order in force at the place of residence of the consumer remain unaffected. With entrepreneurs a.d.u. § 14 of the German Civil Code (BGB), the registered office of the user, Neue Krugallee 212, 12437 Berlin, is agreed as the exclusive place of jurisdiction. In addition, Berlin is the exclusive place of jurisdiction against entrepreneurs a.d.u. § 14 of the German Civil Code (BGB) if there is no general place of jurisdiction in Germany or if the place of business or the place of habitual residence is removed from Germany after the legal relationship has been established or is not known.

 

  1. Additional terms and conditions for the use of the blog

2.1 Registration
Using the blog does not require registration by the user. The blog and website platform is run by the service provider „Wordpress.org“, we hereby explicitly draw attention to their terms of use and data privacy regulations https://wordpress.org/about/privacy/ https://wordpress.org/about/license/ https://wordpress.org/about/security/. These regulations are part of this contractual agreement.

Blog posts can exclusively be commented by the proprietor. The comment function for readers is disabled.

2.2 Fees
Access to the blog is free of charge.

2.3 Change of general terms and conditions
The proprietor retains the right to change or amend the terms and conditions at any given point in time in which case blog users will be notified via the blog page. The new GTCs will be available via the same link of the previous GTCs.

 

  1. Additional terms and conditions for the booking of bodyworks coaching sessions/ packages with fempreneurships (henceforth coaching packages) 

3.1 Booking and conclusion of the contract

3.1.a Selection of service and payment
You can select the coaching service of your choice under http://www.fempreneurships.com/your-secret-body-solutions/. Once you select the coaching package that suits your needs you can schedule a free info call (a free consultation) with one of our fempreneurships staff, using the link right under each package. The info call is free of charge, non-binding and a prerequisite to signing up for any of the fempreneurships coaching programs as we reserve the right to deem the applicant to our coaching programs suiting or not. Once the info call is completed successfully and the fempreneurships staff deems the applicant suiting, the applicant will receive the coaching contract to be signed, which lines out the terms and conditions as well as the content of the respective coaching package via E-mail, together with the invoice for bank transfer or PayPal wiring of the respective amount due. You can choose between the payment method of bank transfer or PayPal transfer, whereas bank transfer is possible only from bank accounts within the EU.

3.1.b Scheduling appointments
In order to schedule the info call appointment, you can follow the link under each respective coaching package stating “schedule your free consultation call for admission”, which will take you to our online calendar. You can select your preferred time and date for the info call by clicking on the date and time subsequently. Once you click to confirm you will be forwarded to the form to enter your E-mail Address, name and your personal interest in taking part in our coaching program. Once you click on ‘schedule event’ your free info call is scheduled.

Our online calendar is operated by the online scheduling service provider ‘Calendly’. We explicitly refer to their GTC and Data Privacy Regulations. These regulations are part of this contractual agreement.

3.1.c Free Info Call
The free 20 minutes info call is meant to establish whether the applicant suits the coaching programs offered by fempreneurships and gives the applicants opportunity to understand, whether and which of the programs suit their respective needs and requirements. The call is executed using the external service provider Skype or via regular phone call (see number under the proprietor information). In case of using Skype, applicants are required to have their own personal Skype account. Also see the Skype GTC and Data Privacy , which are part of this agreement. The info call is free of charge and non-binding. By the end of the call the applicants will be informed on whether they are deemed suitable for our fempreneurships coaching programs.

3.1.d Booking of the Coaching Package
Once the applicants have been deemed suitable to attend the fempreneurships coaching programs they can choose the coaching package that suits their needs and inform fempreneurships on their choice via E-mail. They will be E-mailed the coaching agreement for the respective program to be signed and returned via E-mail to lisa@fempreneurships.com before the commencement of the program. Equally, they will be E-mailed the invoice for the amount due. Coaching agreement and payment (in full or based on the installment provisions) must be on hand 48 hours before the commencement of the program.

3.1.e Payment
The coaching packages can be paid via PayPal or via regular bank transfer. Paying via regular bank transfer is possible only for those holding a bank account in an EU country. Customers will receive an invoice stating the amount due as well as the details for the bank transfer. When paying via PayPal, customers will receive a PayPal invoice that includes the link for the PayPal payment process. Once clicking on the link to pay the PayPal invoice customers will be forwarded to their PayPal account for the completion of payment. The full amount (or in case of installment the respective first installment) is due 48 hours before the commencement of the coaching program.

Extra fees that may be raised by the customer’s bank due to payments that are done from EU bank accounts outside of Germany are to be covered by the customer.

3.1.f Confirmation of receipt and execution of the coaching program
Once the signed coaching agreement and the payment are registered the customer will receive a confirmation E-mail together with the Fempreneurships Welcome Package and program overview, the GTC, Data Privacy Policy and Cancelation Policy. The proprietor saves this E-mail for as long as is necessary to complete the contract and as long as legal and tax law deems necessary.

The coaching packages comprise one or more of the following coaching modes, depending on the package selected: Self-Study Workbooks, Group Online Webinars, Online / in Person One on One Coaching Sessions.

Online coaching sessions are scheduled using the online scheduling service provider ‘Calendly’. The customer will be provided with the link to select and schedule the appointments of their choice in the program overview. We explicitly refer to the Calendly GTC and Data Privacy Regulations. These regulations are part of this contractual agreement.

Online coaching sessions, as well as group webinars, are facilitated using the services of the external service provider „Zoom“. In order to take part in the online coaching sessions/ group webinars, it is required to download the free Zoom App to your end device. Customers receive a link to download the app together with the link to join the call 1 hour before the call/webinar. Note the Zoom GTC https://zoom.us/terms and Data Privacy Policies https://zoom.us/privacy that hereby are explicitly referred to. They are part of this agreement.

Self-Study units are delivered via E-mail to the customer’s E-mail account using the E-mail service provider Mail Chimp. We explicitly refer to their general terms and conditions as well as their data privacy to be viewed at this link: https://mailchimp.com/legal/. These regulations are part of this contractual agreement.

An in-person coaching session takes place at the office of the proprietor.

3.2 Extraordinary cancellation of the contract in case of late payment
The proprietor is authorized to cancel the contract on conducting a coaching session/ delivering a coaching package exceptionally, that is without adherence to the cancellation period if the agreed invoiced amount has not been received on the account of the proprietor in due time.

3.3 Extraordinary cancellation of the contract in other cases
Apart from 3.2, the proprietor is also authorized to cancel the contract on conducting the coaching sessions / delivering the coaching package extraordinarily in the case of a disturbed relationship of trust. This is, for example, the case when, due to special incidents or due to a previous relationship of debt, it is unacceptable for the proprietor to conduct the coaching with the customer. In this case, the full amount is reimbursed by the proprietor asap, in case the coaching package has already been started the value of the remaining unused coaching units are being reimbursed asap.

3.4 Cancellation, Cancellation Fee & Change of Appointment
If the customer cancels the contract, which he entered in accordance with the German Civil Code § 13 BGB, and if the declaration of cancellation occurs within the current period of revocation, the cancellation will be treated as a revocation of the contract. If the customer has already made use of the service, a cancellation according to the German Civil Code § 13 BGB is not possible. The right of an extraordinary cancellation stays unaffected.

The customer can change the appointment that they scheduled for their one on one coaching sessions up to 48 hours before a one on one coaching session without charge. The customer cannot change the appointment if there are less than 48 hours between the intended change of appointment and the originally chosen appointment. The contract can, in this case, be merely canceled, whereas the paid contractual fee can be retained as a cancellation fee; this is not the case as long as the contract can still be revoked.

If the chosen appointment is not kept and if the customer neither expresses the wish to change the appointment nor to cancel/revoke it, the session will not be reimbursed or rescheduled.

The customer is at liberty to use the remaining elements of the coaching package. In the following urgent cases, the proprietor and the customer are respectively allowed or obligated to change the booked appointment without charge, according to the agreement with the contractual party:

– the sudden illness of the proprietor
– the sudden illness of the customer
– lacking technical accessibility at the chosen appointment
– the impossibility of conducting the session due to an act of nature beyond control/force majeure

3.5 Reimbursement of costs in case of a cancellation by the proprietor
If due to an extraordinary or ordinary cancellation by the proprietor, the booked coaching package is not carried out, the paid amount will be reimbursed to the customer without deductions.

3.6 Disclaimer
Accompanying Kinesiology and Bodyworks are used concomitantly, they are not a healing/medical science and are not a substitute for medical or psychotherapeutic treatments. They are to be understood as business, health and life counseling and do not serve the treatment and cure of illnesses. In the case of health problems or diseases, the customer should, therefore, seek healing/medical treatment (i.e., medical or psychotherapeutic) treatment, i.e. the help of a physician, traditional healer or psychotherapist.

The customer should not stop or interrupt necessary healing/medical (ie, medical or psychotherapeutic) treatments, solely due to the training specified in this agreement. http://www.dgak.de.

4.1 Booking and conclusion of a contract

Once you select the workshop that suits your needs you can schedule a free info call (a free consultation) with one of our fempreneurships staff, using the link right under each package. The info call is free of charge, non-binding and a prerequisite to signing up for any of the fempreneurships coaching programs as we reserve the right to deem the applicant to our coaching programs suiting or not. Once the info call is completed successfully and the fempreneurships staff deems the applicant suiting, the applicant will receive the invoice for bank transfer or PayPal wiring of the respective amount due. You can choose between the payment method of bank transfer or PayPal transfer, whereas bank transfer is possible only with bank accounts within the EU.

In case workshops are fully booked you do get the option to sign up to the waiting list. The link under the respective workshop packages will direct you to the waiting list sign up form.

For speaker engagements or requests of external workshop organizers for an in person or online workshop by fempreneurships you can send an E-mail to lisa@fempreneurships.com. Terms and conditions are agreed upon on an individual base.

4.2 Payment
The workshop can be paid via PayPal or via regular bank transfer. Paying via regular bank transfer is possible only for those holding a bank account in an EU country. Customers will receive an invoice stating the amount due as well as the details for the bank transfer. When paying via PayPal, customers will receive a PayPal invoice that includes the link to the PayPal payment process. Once clicking on the link to pay the invoice it will be forwarded to the Customers PayPal accounts for the completion of payment. The full amount (or in case of installment the respective first installment) is due 4 days prior to the commencement of the workshop.

Extra fees that may be raised due to payments that are done from bank accounts outside of Germany are to be covered by the customer.

4.4 Workshop execution
Online group webinars are facilitated using the services of the external service provider „Zoom“. In order to take part in the online webinars, customers are required to download the free Zoom App to their end device. Customers receive a link to download the app and to join the call 1 hour before the call/webinar. Note the Zoom GTC https://zoom.us/terms and Data Privacy Policies https://zoom.us/privacy that hereby are explicitly referred to. They are part of this agreement.

Self-Study units are delivered via E-mail to the customer’s E-mail account using the E-mail service provider Mail Chimp. In case of in-person workshops or speaking engagements, the venue will be announced with the payment of the program fee.

4.3 Workshops offered by external organizers
In case of external organizers facilitating the workshop or webinar, contract, cancellation policy, and payment underlie the guidelines of the external organizer. External workshops, webinars, and speaking engagements can be found here: http://www.fempreneurships.com/speaker/

4.4 Cancellation, Cancellation Fee & Change of Appointment
See 3.3-3.4 with the exception that cancellation is possible up to 4 days in advance only. The proprietor retains the right to cancel the workshop in case of an insufficient number of participants up to 4 days ahead of the workshop. In this case, fees are immediately and completely reimbursed.
